1.     Introduction

 

Please read Our terms and conditions below carefully as it is related to Your rights and liabilities under the law and also sets out the terms in which Deed Poll Direct provides any products or services via the website of www.deedpoll-direct.co.uk. The following terms and conditions are governed by the laws of England.  

 

In order to purchase a service and/or a product via Our website, You will be asked to agree to these terms and conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

 

The Company reserves the right to reasonably alter the Terms at any time.

 

2.     Interpretation

 

"You" and "Your" shall be construed as referring to the person purchasing and downloading Our product or service, thereby entering into a contractual relationship with Us.

 

"We", "Us", and "Our" shall be construed as referring to Deed Poll Direct.

4.     Our guarantee

 

We guarantee that Your deed poll will be accepted by British Record holder, including the Passport Office, DVLA, HMRC, banks, etc. (Excluding foreign embassies and consulates).

 

If any UK based organisation refuses Your deed poll as proof of Your name change, You will be entitled to a full refund of all the money paid to Us, subject to production of satisfactory evidence of refusal and compliance with any reasonable requests from Us. This is the limit of Our liability.

 

The refund will take between 2-5 working days to be completed.

 

Our guarantee is subject to the exceptions mentioned in section number five below.

 

5.     Exceptions to our guarantee

 

"Record holder" means a public department, company or organisation. Our guarantee does not apply if:

  • Your deed poll was incorrectly completed and/or signed and/or witnessed.
  • Your Deed Poll is not accepted by a non UK record holder, such as foreign embassies and consulates.
  • You are changing Your name to give the appearance that You hold a title which you do not hold.
  • You are a foreign national.
  • your Deed Poll is not accepted because the record holder's parental consent requirements have not been met.
  • If a record holder requires other documentary evidence that proves that your name has been changed for "all purposes", for example, some banks and the General Medical Council might request to see your passport in your new name before they are able to recognise your new name. Also, The Passport Office might request evidence which shows that you are using your new name for all purposes by sending them further documents in your new name.
  • The record holder decides that Your new name breaches their inappropriate or temporary name change policy.
  • If you are a dual national, and the Passport Office has rejected your application because you have not changed your other passport yet.

If You have any doubt to whether Your deed poll would be covered by Our guarantee, then You should contact Us before purchase.

 

6. Cancellation

 

The following information is provided in accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations and with The Distance Selling Regulations.

  • The Regulations allow you to cancel your order within 14 days of submitting your application.  However, because we will be preparing your Deed Poll documentation before the end of the cancellation period (and will have fully performed the service you have requested), your right to cancel is restricted to the period of time from submitting your application to when we prepare your Deed Poll documentation.  This is in accordance with section 36(2) of The Regulations.  By submitting an order, you are agree to waive your 14 day cancellation rights under The Regulations.  Therefore, if you wish to cancel your order (and receive a full refund if you have made payment), you must notify us by email before we prepare your Deed Poll documentation.

7. Mistakes

  • If you make a mistake, you must notify us within 28 days of receipt. You have made a mistake If there is an error on your deed poll and the details match the confirmation email. A new deed poll needs to be ordered by you and paid in full.
  • If we make a mistake, we will provide a free replacement, which will be dispatched within 1-2 working days. You must notify us within 28 days of receipt. We have made a mistake if there is an error on your deed poll and the details do not match the confirmation email.
  • If you return your Deed poll documentation to us in error, then you need to pay the full cost of returning the documentation to you.

8. Price and Payments

£4.00 per duplicate copy.

''Save my order'' this option allows you to order copies of your deed poll in the future for a discounted price. Without this option, you will also be able to order copies of your deed poll but for the standard price and not the discounted one. Without this option, we will keep your details for a limited period of time only. 

 

We accept the following payment types: Visa Debit, Visa Credit, MasterCard and American Express.

 

9. Type of the product and what will You receive

 

The product is: Deed Poll. The papers we use are the standard good A4 printing papers. All copies will have a red sticker on them. 

 

The envelope We send you will contain the following:  

  • One Deed Poll.
  • Duplicate copies of the Deed Poll, if ordered.
  • Easy-to-follow guide. 
  • List of organisations you might need to notify.

10. Intellectual property

 

The contents of deedpoll-direct.co.uk website (including but not limited to photos, texts and graphics) are protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the deedpoll-direct.co.uk website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify copy or distribute or use for commercial purposes any of the materials or content on the deedpoll-direct.co.uk website.

 

All contents of our products, such as Deed Poll, You purchase from Our website or receive from Us by email and or by post (including but not limited to templates, guides and any other materials) are protected by copyright, trademarks, database and other intellectual property rights. The Protection applies if the materials are saved digitally and/or when they are on papers (have been printed). You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content You have purchased and or downloaded from Us.

You agree that Deed Direct will not be liable to you or any third party for any consequential or incidental loss or damage (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other direct, indirect, special or punitive damages whatsoever that arise out of or are related to the use of Our products, Service and website.

 

12. Review

 

We might contact you by email to ask you to leave us a review on a third party website. We might send you the request to the email address which you used to place the order. It is an optional and you do not need to leave us a review. 

 

13. Affiliation 

 

In the UK, there is NO such thing as an official Deed Poll service. Some websites may try to trick their visitors into thinking that they are an official service. The truth is that all deed poll service providers are private companies.
